Terms and Conditions

Shipping

Information about our shipping policies is available on our shipping page.

Please note: A signature is not required for delivery. By placing an order, you agree that our responsibility for the shipment ends when the carrier confirms delivery. We are not responsible for loss, theft, or damage that occurs after delivery.

Sales Tax

Sales tax is collected on shipments to Georgia based on the applicable tax rate for the county in which delivery is made. If you are purchasing items for resale or otherwise qualify for a sales-tax exemption, you may complete the Georgia State Sales Tax Exemption Form ST-5 online and mail it to us. After submitting the form, please contact us for instructions on placing tax-exempt orders.

Payments

Orders must be prepaid by credit card, PayPal, money order, check, or wire transfer. We accept Visa, Mastercard, Discover, and American Express.

Purchase orders are accepted from governmental and educational institutions.

Services and Conditions of Use

As part of our service, we provide information and may offer other services, all subject to this agreement. We may modify this agreement at any time by posting notice through the service. By using or continuing to use our services, you agree to comply with all applicable laws and regulations and with the terms, policies, and guidelines stated below. In this agreement, the term “customer” refers to the person or entity using our services.

Limitation of Liability and Warranty

We take great care to keep our plant stock true to name. If satisfactory proof establishes that any stock is not true to name, we will replace the affected stock or refund the amount paid for it. Our liability will not exceed the original purchase price. Claims that stock is not true to name must be submitted within ten days after receipt of the shipment.

All other claims, including claims for shortages, must be submitted within three days after receipt of the shipment. In all cases, our liability is limited to the invoice price of the affected plants.

We guarantee that plants are healthy and in good condition when shipped. We do not assume responsibility for their growth or survival after delivery. If plants arrive damaged or a shipment is excessively delayed, note the condition on the carrier’s delivery receipt and file a claim with the carrier immediately. Our responsibility for the shipment ends when the carrier confirms delivery.

THIS DISCLAIMER APPLIES TO ANY DAMAGE OR INJURY ARISING FROM A FAILURE OF PERFORMANCE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR TRANSMISSION; COMPUTER VIRUS; COMMUNICATION-LINE FAILURE; THEFT OR DESTRUCTION; OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORDS, WHETHER THE CLAIM IS BASED ON BREACH OF CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER CAUSE OF ACTION. THE CUSTOMER SPECIFICALLY ACKNOWLEDGES THAT WE ARE NOT LIABLE FOR DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT BY OTHER CUSTOMERS OR THIRD PARTIES AND THAT THE CUSTOMER ASSUMES THE ENTIRE RISK OF INJURY ARISING FROM SUCH CONDUCT.

NEITHER WE NOR OUR AGENTS, AFFILIATES, OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE; INABILITY TO ACCESS OR USE THE SERVICE; OR BREACH OF ANY WARRANTY. We welcome submissions of plant photographs for possible inclusion on our website. Please submit only images that you own or otherwise have the right to publish.
